I'd like to include a bottle of wine in a gift basket that i sell online. Do I need a liquor license?

Every single state requires a license to sell any alcoholic beverage. There are many different types but all are required. Beyond the license you must then determine if you can ship to the state as those laws vary state to state as well. On top of that you'll need age verification and adult signature required. You also need to ship it temp controlled since it is perishable and driving around in a hot van for even a few hours will ruin it.


I sell about 2K wine gift baskets a year out my stores all locally. I do not ship. There are too many risks and restrictions.


What happens if the person isn't there when its delivered?


What if there's no adult home?


As soon as you add alcohol to the equation things get very complicated.


Just some advice from someone's who been through it all.

What I would recommend (because each state has different laws, and you could get in big trouble for selling wine if it accidentally is sold to a minor), is that you include a sum equal to the amount you would spend on the wine, as a gift certificate to a national chain.

How about a nice bottle of sparkling cider.
Reply:yes..even ebay does not allow the sell of wine or alcohol for the same reason. If you do sell it on ebay you have to state that you are selling it for the collectable value of the bottle itself and not the contents.

Reply:Yes, unfortunately you do and you need a commercial (business) residence in order to apply for one (at least in my state). Then even if you get one, you have to make sure that the state in which it is purchased (since it is online, that could be anywhere) allows wine to be sent through the mail.

We can only ship wine gift baskets to AK, AZ, CA, CO, CT, DC, FL, HI, ID, IL, IA, LA, MN, MO, NE, NV, NH, NM, NC, ND, OH, OR, SC, TX, VA, VT, WV, WI, WY. Wine baskets containing Crane Lake, Fox Hollow or Pinebrook may be shipped to VA. The Supreme Court has ruled in favor of opening up interstate commerce, but the court does not tell the states how to change their laws. It is up to each state's legislature to react to the ruling and establish and enforce their own alcohol related shipping policies. This will take some time. Check back for an updated list of states where we can deliver wine to; hopefully more states will be added soon!








There are clearly state restrictions as it's illegal in certain states (NY %26amp; Washington state for example).





You also need to safeguard and ensure the alcohol isn't landing in the hands of a minor. BIG FINE for you if that happens. (May need an adult to sign for each shipment and verify it.)
